Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Fuzzly website at fuzzlydesigns.com and any related services (collectively, the "Services") operated by Fuzzly Designs LLC ("Fuzzly," "we," "us"). By using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or have parental consent, to use the Services and place orders.

2. Orders, pricing, and shipping

All prices are listed in US Dollars. Orders are accepted upon successful payment authorization. We may decline or cancel any order at our discretion, including for suspected fraud, errors in pricing, or items that violate our content policy. Shipping times are estimates; we are not responsible for carrier delays.

3. Custom and personalized products

Products customized with your photos, names, or personalization are made to order. Because they cannot be resold, custom items are final sale except where the product arrives damaged or materially differs from the order. See our return policy below.

4. Returns and refunds

• Damaged or defective items: contact us at [email protected] within 14 days of delivery with photos. We'll replace or refund.
• Non-personalized items: may be returned within 30 days in original condition for a refund minus shipping.
• Personalized items: non-returnable except for damage or defect.

5. Your content and intellectual property

You retain ownership of any photos or designs you upload. By uploading, you grant Fuzzly a limited license to use your content solely to produce and ship your order. You represent that you have the rights to all content you upload and that it does not infringe any third party's intellectual property or privacy rights.

The Fuzzly name, logo, designs, code, and Site are owned by Fuzzly Designs LLC and protected by copyright, trademark, and other laws.

6. Acceptable use

You agree not to: (a) upload illegal, hateful, harassing, sexually explicit, or infringing content; (b) attempt to disrupt, reverse-engineer, or gain unauthorized access to the Services; (c) use the Services to send spam, scrape, or harvest data; (d) impersonate any person or entity. We may remove content and terminate accounts that violate these Terms.

7. Third-party integrations

The Services use third-party providers (Stripe, Gelato, Prodigi, Printful, Printify, Pinterest, Meta, Google, Cloudflare, Railway, Resend). Use of those services is subject to their own terms.

8. Disclaimers and limitation of liability

The Services are provided "as is" without warranties of any kind. To the fullest extent permitted by law, Fuzzly's total liability for any claim arising out of or relating to the Services is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.

9. Indemnification

You agree to indemnify Fuzzly from any claim arising out of content you upload or your violation of these Terms.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA. Any dispute must be resolved in the state or federal courts located in Delaware, except where prohibited by applicable consumer-protection law.

11. Changes

We may update these Terms from time to time. Material changes take effect 14 days after posting.
